WR Landry will not face battery charges

No charges will be filed against Miami Dolphins wide receiver Jarvis Landry after a Broward State Attorney’s Office investigation into a potential domestic battery incident from April.

Prosecutors said that an investigation determined there was “no reasonable likelihood” of a conviction. The case involved an April 1 encounter between Landry and Estrella Cerqueira, the mother of their daughter.

“The victim maintains that the defendant did not intent to touch her (or) strike her, but accidentally did so,” said a memorandum filed Monday by assistant state attorney Stefanie Newman.

There were no witnesses to the encounter at Landry’s residence, and video surveillance appeared to corroborate Cerqueira’s account, the prosecutor said.

It’s unclear whether Landry could still face punishment from the NFL under its personal conduct policy, which doesn’t require an arrest, charges or a conviction.

Landry issued a statement Tuesday expressing his relief that this phase of the situation is over.

“I am very thankful that this matter is over and my family and I can put this behind us now,” he said. “I greatly respect and appreciate the Broward County State Attorney’s Office for their hard work and thankful that they were able to come to a conclusion that reaffirms the true facts that no crime was committed.

“My daughter’s mother and I will continue to coparent to raise our child in a happy and healthy environment. I would like to thank my family and friends for their continued support throughout this process.”

When news of the investigation surfaced in August, Cerqueira released a statement that said in part, “I was not in any way physically harmed. Yes, we are going through a civil family court case and emotions are high, but I would like to make it very clear that Jarvis would never, ever do anything to harm me or anyone else. Jarvis and I are happily raising our beautiful daughter.”
