Man who stole ATM gets 10-year sentence

A man who stole an ATM from a Texarkana, Ark., grocery market after ramming a stolen truck through the storefront last year was sentenced to 10 years in prison Monday as part of a plea bargain.

Joshua Lamar Rigsby, 35, was arrested in May 2017 in connection with a predawn theft April 28, 2017, of an ATM from Sav-A-Lot grocery on College Hill Drive in Texarkana, Ark., Police officers responding to an alarm at the business at approximat­ely 4:45 a.m. discovered the the store had been struck multiple times with a pickup later determined to have been stolen from McLarty Ford in Texarkana, Texas, according to a probable cause affidavit used to create the following account.

In the debris, investigat­ors found pieces of the truck, a black hat and a set of keys to a Lincoln which turned out to belong to Rigsby’s wife. Using that evidence and more, officers were able to identify Rigsby as the suspect.

Early estimates of the loss to the just the bank which owned and operated the ATM were $2,400 for the cash inside the machine and $2,600 for the equipment itself.

Rigsby appeared Monday before Circuit Judge Kirk Johnson with Texarkana lawyer John Pickett for a hearing at the

Miller County Courthouse. Chief Deputy Prosecutin­g Attorney Chuck Black told the court the state had agreed to dismiss a charge of felon in possession of a firearm in exchange for Rigsby’s plea to commercial burglary and theft of property.

Rigsby received a 10-year prison term on each of the two charges to be served concurrent­ly. However, Rigsby won’t begin serving the 10-year sentence until he has finished serving a six-year term for theft by receiving. Rigsby was initially sentenced in February 2017 to a six-year term of probation but his probation was revoked in December 2017 and a six-year prison term imposed.

Black said Rigsby’s time on the charges related to the ATM theft won’t begin running until he has satisfied his sentence on the probation revocation. According to the Arkansas Department of Correction website, Rigsby has at least 15 prior felony conviction­s in Arkansas
