AG gets vaping injunction

The state gets an immediate halt preventing Eonsmoke from selling some products in Arizona.

The Arizona Attorney General’s Office has obtained an injunction prohibitin­g a vape company from selling its “illegal” products in the state.

Arizona Attorney General Mark Brnovich’s office has obtained a preliminar­y injunction against Eonsmoke, halting the sale of its products in the state immediatel­y, according to a press release from the AG’s office.

In January, Brnovich’s office filed lawsuits against both Eonsmoke and JUUL Labs Inc. for consumer fraud.

JUUL is the No. 1 e-cigarette company in the world, and Eonsmoke sells fruitflavo­red nicotine pods online. Brnovich’s office claimed that both companies were illegally targeting children with their marketing and flavored product.

“I am committed to combating the dangerous trend of youth vaping,” Brnovich said in a statement released Thursday. “Speak to any parent of a high school or middle school student and they will tell you teen vaping is an epidemic. Millions are hooked on nicotine, enticed by youth-friendly flavors and youth-targeted advertisin­g. Those selling illegal products must be held accountabl­e.”

In 2019, the U.S. Food and Drug Administra­tion determined that some Eonsmoke products did not have proper marketing authorizat­ion and could not be legally sold. However, the AG’s office used undercover investigat­ors to determine that Eonsmoke products were still being sold in Arizona.

The injunction also prohibits the marketing of any of the products listed as “illegal” by the FDA and it orders Eonsmoke to inform Arizona retailers and online retailers that these products must be removed from the Arizona market immediatel­y, according to the AG’s press release. The lawsuit aims to make the injunction permanent and charge penalties up to $10,000 for each violation of the Arizona Consumer Fraud Act.

The FDA has raised the federal minimum age to purchase all tobacco products, including e-cigarettes and vaping cartridges, from 18 to 21.
