City readying possible opioid lawsuits

Opioid litigation has been authorized by the Marietta City Council.

Mayor Steve Tumlin and the City Council now may pursue legal action against opioid manufactur­ers, distributo­rs and others “as are necessary, either by itself or in concertwit­h others, and to the full extent available under the law,” according to their Oct. 10 decision.

In a separate motion, the Council agreed to retain J. Anderson Davis and his law firm, Brinson, Askew, Berry, Seigler, Richardson & Davis LLP, and its lawyers — based in Rome — for opioid litigation.

The attorneys will be asked “to investigat­e, research and prepare claims or complaint(s) to file in any appropriat­e Court or before any appropriat­e government­al agency as it relates to opioid litigation.”

With the national increase in opioid overdoses, more jurisdicti­ons, including Cobb County, are joining resources to file a national lawsuit against opioid manufactur­ers and pharmacies.

Cobb County District Attorney Vic Reynolds informed the Cobb County Board of Commission­ers this month, “In 2017, Cobb County led the state and other larger counties in the reported number of opioid overdose deaths and saw a 49 percent increase in deaths associated with opioid use over the past two years.”
