Lyft driver alerts cops to burglary plot

That man was arrested about seven hours later after being evicted from a Columbus apartment and accused of causing a disturbanc­e. He reportedly admitted to breaking into his parents’ home, stealing the safe and trying to sell the jewelry.

A second suspect also has been identified. Both have been charged with burglary. Dispatch Courts Reporter John Futty.

Tyack, an appeals court judge for 24 years, said he’s known of similar behavior by other judges that didn’t result in complaints from the Ohio Supreme Court’s disciplina­ry counsel.

He called the allegation­s against Horton “much lower-grade than some of the other things I’ve been aware of in central Ohio,” drawing an objection from Assistant Disciplina­ry Counsel Casey Russo.

Robert Fitzgerald, a Lima attorney who is chairing the three-member panel hearing the case, overruled the objection but noted that Tyack’s comment “was not responsive” to the question that was asked.

Horton spent 10 days in jail last year after pleading guilty to misdemeano­r charges of filing improper campaign-finance reports. The disciplina­ry counsel complaint cites the conviction­s and also accuses the judge of sexually harassing a secretary and a summer intern in his office while serving as a Franklin County Common Pleas judge and misusing staff and resources by asking court employees to do campaign work on county time.

Tyack got into a pointed exchange with another panelist, Toledo attorney Patricia Wise, when she asked about two previous witnesses who testified that they felt uncomforta­ble reporting Horton’s behavior.

“With all due respect, that is nonsense,” Tyack replied.

Tyack said he had reached that and other conclusion­s about the case despite not reading the disciplina­ry counsel’s complaint.

The disciplina­ry hearing will continue in September. The Board of Profession­al Conduct panel will recommend penalties, including suspension or disbarment, if the panelists find misconduct.
