Judge: Toddler to remain with woman’s parents

A judge ruled Thursday that Kelsey Berreth’s 1year-old daughter will remain in the custody of her maternal grandparen­ts at least until April.

Patrick Frazee, 32, the father of Kaylee, is seeking to gain custody of his daughter even while he is in jail awaiting a murder trial in Berreth’s death.

The next custody hearing is scheduled for April 4 in Teller County District Court, according to a tweet by Rob McCallum, spokesman for the Colorado State Court Administra­tor’s Office.

Frazee faces charges that he killed Berreth and solicited her murder. Kaylee has been with Berreth’s family since Frazee’s arrest in December.

Berreth’s body has not yet been discovered. Berreth, 29, was last seen on Thanksgivi­ng Day with Kaylee. Later that afternoon, she and Frazee met to exchange their daughter. The two were engaged but did not live together, police have said.

Three days later, her phone pinged a cellphone tower in Gooding, Idaho, and her employer received text messages from her phone saying she wouldn’t be at work the following week.

A nurse living in Twin Falls, Idaho, has been charged with one count of tampering with physical evidence in connection with the Berreth murder case, according to Colora- do prosecutor­s.

Krystal Jean “Lee” Kenney is scheduled to appear in Teller County District Court in Cripple Creek on Friday for an advisement hearing, Lee Richards, spokeswoma­n for District Attorney Dan May, has said.

Felony charges were filed against Kenney on Monday, according to court records. The probable cause statement has been sealed.

According to court records, Kenney is accused of committing the tampering crime on Nov. 24, two days after authoritie­s believe Berreth was murdered.
