Police: Teacher twice sexually assaulted student

Fallon Miner, 25, faces two counts of sexual assault on a child

According to an arrest affidavit written by Fort Morgan Police Detective Sgt. Palmer Anguiano, former Fort Morgan High School English teacher, Fallon Miner, allegedly had sexual intercours­e with a minor twice at her apartment located in the 400 block of Southridge Road in the last week of February.

The affidavit reads the victim, whose name was redacted, spoke on March 2 in a meeting with Student Resource Officer Anthony Gagliano, FMHS Principal Clint Anderson, Morgan County School District Re-3 Director of Human Resources Brian Childress, and Anguiano. The victim’s father was also present.

In the meeting, the affidavit reads the victim said they had developed “romantic feelings” for Miner when she gave the victim and friends a ride to an unknown location two weeks before. The affidavit continues on to read that the victim stated they went on a date on the evening of Feb. 25, in Denver, with Miner to Skate City and then went out to eat at Outback Steakhouse.

Per the affidavit, the victim was “very evasive” as to what transpired on the date, but stated the only affection they showed each other was holding hands. The victim and Miner kissed during one of the hand-holding sessions, the affidavit reads. These events were later confirmed, by Anguiano, to be consistent with the victim’s statement to school administra­tors.

The juvenile victim had originally told police that Miner dropped him or her off at the home of a friend, with Miner leaving for her apartment at the conclusion of the date, the affidavit reads.

However, later in the day, Anguiano was informed by Shanna

Schnegelbe­rger, a friend of Miner, that Miner had admitted herself to a care facility “due to mental issues she was having,” the affidavit reads.

That evening, Anguiano received a call from FMPD officer Jordan Dean detailing receipt of a call from Danielle Vigil, a licensed profession­al counselor candidate with Peak View Behavioral Health, a psychiatri­c hospital in Colorado Springs. In a mandatory report to Officer Dean, Vigil disclosed Miner was under her care and Miner said the relationsh­ip between her and the victim was sexual in nature and they did have intercours­e.

FMPD arrested Miner on March 8 in Colorado Springs at the psychiatri­c hospital.

Anguiano re-interviewe­d the victim at their home, shortly before the arrest, with the victim confirming they had intercours­e with Miner, the affidavit reads. The victim admitted lying to Anguiano by saying Miner dropped them off at a friend’s home after the date. Rather, the victim was taken back to Miner’s apartment, the affidavit reads. The victim could not recall what time they arrived at Miner’s apartment, but “didn’t think that they would have gotten back to the apartment any later than midnight.”

The juvenile victim and Miner watched a movie on the couch, then went into her bedroom and had sexual intercours­e, the affidavit reads. The victim stayed the night with Miner, the affidavit reads, and when they awoke in the morning, they had intercours­e again.

Miner is facing a police charge of sexual assault on a child by one in position of trust, a Class 4 felony, and sexual assault on a child by one in position of trust with a pattern of abuse, a Class 3 felony.

Per the affidavit, Miner was running a book club at FMHS when she was teaching and the victim was in the club.

The day following her arrest, Judge Matthew Bradley issued Miner a $5,000 personal recognizan­ce bond for release. Miner’s next court date is scheduled for 9:30 a.m. March 30 at the Morgan County Justice Center.
