Man who rammed boat on Lake St. Clair agrees to pay $2,500 deductible for repairs
A man who rammed a boat with his vessel on Lake St . Clair in June 2019 and the boat owners agreed he will pay $2,500 restitution for damage to the boat.
Timothy Kennedy, 40, of New Baltimore, will pay the amount to cover the cost of the couple’s insurance coverage deductible to repair the boat, according to Macomb County Circuit Court records.
The matter was set for a restitution hearing Tuesday that would have involved attorneys for Kennedy and the county Prosecutor’s Office arguing over an amount, but records say the matter has been resolved with the agreement.
Kennedy in March pleaded no contest to malicious destruction of property over $20,000, assault with a dangerous weapon and operating while intoxicated. Last May he received two-years probation and a one-year deferred sentence, meaning the jail term could be removed by circuit Judge Jennifer Faunce if he complies with conditions. He was ordered to serve the first three months on house arrest and complete an impulse-control class while on probation.
The incident occurred about 6 p.m. June 29, 2019, off the shore near Brandenburg Park in Chesterfield Township. Kennedy was accused of using a fishing boat he was steering to ramand cause damage to a larger boat. He fled the area but was caught by Macomb County Sheriff’s Office Marine Division deputies.
The couple aboard the larger boat said they did nothing to provoke the attack, police said.
