Driver sentenced for hitting pedestrian on side of road
Timothy Enquist entered no-contest plea to first-degree negligent injury
WAILUKU — A man was given a chance to keep a felony conviction off his record for a traffic collision in Paia last year that left a pedestrian with a permanent injury.
Timothy Enquist, 50, who has no local address, had pleaded no contest to first-degree negligent injury.
The collision occurred shortly after 11 a.m. April 20, 2019, on Hana Highway near
Hookipa Beach Park in Paia.
A police investigation showed Enquist was driving west on the highway when he crossed the white solid fog line and collided into a man walking west along the shoulder of the road. The pedestrian was thrown into the air in the collision and suffered permanent loss of motion in his left arm, police reported.
At his sentencing June 18, Enquist was given credit for nearly three months he had previously spent in jail.
Second Circuit Judge Kelsey Kawano granted Enquist’s request for a chance to keep the conviction off his record if he follows court requirements for the next five years.
While Enquist has a traffic record that includes a number of convictions for offenses including speeding and driving without a license and insurance, “this seems to be an aberrant first-time felony conviction for you,” Kawano told the defendant.
“Those prior offenses do not seem to me to have a sufficient linkage to this particular offense,” Kawano said.
No restitution was requested by the victim.
Enquist was ordered not to consume alcohol or illegal drugs.
