Judge ups bail to $20,000 for man accused of assault
WAILUKU — A judge increased bail to $20,000 for a Makawao man who was arrested for allegedly assaulting a relative who had obtained a court order for protection.
Scott Hickey, 39, is charged with second-degree assault, abuse and violating an order for protection.
During Hickey’s initial appearance Monday in Wailuku District Court, Deputy Prosecutor Anthony
Herndon sought the increase in bail from $3,000 to $20,000 “based on the seriousness of the allegations.”
He said the victim, who is over 60 years old, has an active order for protection against Hickey. He reportedly violated the order by headbutting her Oct. 9, Herndon said.
He said that if convicted, Hickey could face sentencing as a persistent and repeat offender with 17 prior convictions, including felony convictions for second-degree robbery, second-degree criminal property damage, third-degree promotion of a dangerous drug and unauthorized control of a propelled vehicle.
Hickey is on probation in two 2018 cases, Herndon said.
Deputy Public Defender Gustavo Gonzalez opposed any increase in bail.
In granting the prosecution request, Judge Blaine Kobayashi said “there is justification for the increase in the defendant’s bail, given the defendant’s extensive prior criminal history.”
“The court believes the defendant is a danger to the community,” Kobayashi said.
Hickey was ordered to have no contact with the victim and to stay away from her residence in Makawao.
Police records show Hickey was arrested Friday afternoon.
