Passenger killed in Highway 101 crash ID’d

Toyota minivan hit BMW that, for unknown reason, was stopped in the slow lane

SAN JOSE >> The Santa Clara County Coroner’s Office has identified the female passenger who was killed early Sunday in a crash on Highway 101 as 20-year-old Jaime Leandra Pena.

The coroner’s office did not have Pena’s city of residence.

Pena was riding in the front passenger seat of a BMW sedan that, for reasons still under investigation, came to a stop in the far right lane of northbound Highway 101 between Capitol Expressway and Tully Road around 4:25 a.m, according to the California Highway Patrol.

The BMW did not have its lights on when it came to a stop in the slow lane, according to the CHP. A Toyota minivan hit the rear of the BMW, spun around 180 degrees and stopped with its lights off as well.

The driver of the minivan got out of the vehicle and ran to the right shoulder. A big rig traveling around 50 mph then hit the Toyota, spinning it around.

The CHP arrested the 29-year-old driver of the BMW, Juan Oviedo of San Jose, on suspicion of driving under the influence, according to Officer Ross Lee. Oviedo was also hospitalized with a broken arm.

Once the CHP completes its investigation, the case will be sent to the Santa Clara County District Attorney’s Office, where prosecutors will decide what charges, if any, should be filed.

The big rig suffered damage to its oil pan and leaked about 8 gallons of engine oil into a storm drain. A Caltrans crew cleaned up the oil in the storm drain before the lanes were reopened.
