Elyria Medical Center sued

Elyria Medical Center is being sued by the Ohio Department of Health to recoup alleged unpaid fees.

In a complaint filed June 19 in Lorain County Common Pleas Court, the state Department of Health claims Elyria Medical Center, 160 Cleveland St. in Elyria, failed to pay inspection and licensing fees dating back to 2008.

According to the suit, the Medical Center failed to pay a $256 radiation generating equipment inspection fee until seven months after the invoice was dated.

Legally, after 90 days without payment of a fee of this kind, the invoiced price doubles. After 180 days, the fee is quintupled.

According to the lawsuit, neither of these additional fees were paid.

The suits says the Medical Center also failed to pay a radioactiv­e materials licensing renewal fee in 2011. The initial cost of this renewal was $2,124.75.

After 90 days, an additional fee of $2,124.75 was invoiced to the Medical Center. After 180 days, an additional $6,374.25 was tacked on.

According to the suit, neither the initial renewal fee nor the additional penalties were paid.

The Medical Center also failed to pay a $950 health care facility inspection fee, according to the suit.

Additional­ly, the suit says the facility failed to pay a $307 radiation generating equipment inspection fee in 2012.

An additional fee of $307 was assessed after 90 days and an additional fee of $912 was added after 180 days. The facility failed to pay these fees as well, the suit claims.

A radiation generating equipment licensing fee of $262 from 2013 also was not paid, according to the filing.

Because of a change in the law, after 90 days only a 10 percent late fee would be assessed. As such, a $26.20 late fee was added and remains unpaid, according to the filing.

The suit requests $14,420.95 for the unpaid licensing, inspection and late fees. It also request $2,148.76 in prejudgeme­nt interest and $7,180.11 in collection­s fees.

The filing also requests post judgment interest on the fees as well.

Representa­tives for the Medical Center could not be reached for comment.
