Police arrested a man they say shot his neighbor’s dog for causing harm to his dog.

Officers responded to shots fired on Brace Avenue in Elyria, about 3 p.m. Jan. 8, according to an Elyria police report.

Timothy J. Kilgore, 28, of Elyria, is facing charges of cruelty to animals, a fifthdegree felony, and discharging a firearm within city limits, a fourth-degree misdemeanor, the report said.

Officers detained Kilgore and his wife, a 29-yearold Elyria woman, and searched 226 Brace Ave. for weapons, according to the report.

Kilgore told police where to find the weapon, and they retrieved a 12-gauge shotgun, with one spent 00 buck shell and five additional lives rounds, from an upstairs bedroom, the report said.

Kilgore’s wife told police she let her German shepherd puppy out in the backyard and saw her neighbor’s Husky attacking her pet through a fence that separates the two residences, the report said.

She stated she screamed and went out to help her dog.

The wife told police that Kilgore came out seconds later with a shotgun and shot the neighbor’s dog once, according to the report.

The neighbor, a 52-yearold Elyria woman, told police she didn’t see the dogs fighting, but reacted when she heard the gunshot and her dog whimpering.

She told police she found her dog deceased in her driveway, the report said.

The dog was picked up by the Lorain County Dog Warden.

Kilgore is out on bond and is not allowed to make contact with his neighbor, nor is he allowed to possess a firearm.

He waived his preliminary hearing Jan. 9 and his case will go to a grand jury for review.
