2 men arrested after gun is thrown out of a vehicle

Two men were arrested after driving past police and throwing a gun out of a moving vehicle Jan. 12, according to an Elyria police report.

Jamie L. Boggs, 19, of North Ridgeville, was charged with tampering with evidence, a third-degree felony, improper handling of a firearm in a motor vehicle, a fourth-degree felony and receiving stolen property, a fourth-degree felony.

Aubrey F. Brown, 22, of Elyria, was charged with failure to comply with police order, a third-degree felony.

Police arrested the pair at 2 a.m. on Allen Street in Elyria, according to the report. Officers initially noticed a red Ford Ranger, driven by Brown with Boggs in the passenger seat, traveling slowly on Allen Street with its headlights turned off, the report said.

The truck accelerate­d rapidly and officers followed it as it turned north on Barbara Street, according to the report.

Officers noticed the Ranger was swerving back and forth in the roadway. The Ranger went over a curb, and into a lawn, before returning to the roadway and traveling south on Garden Street.

The truck then traveled to the 1100 block of Garden Street and struck a street sign and a parked car, according to the report.

The vehicle continued on the grass heading east before coming to rest after hitting a fire hydrant on Garden Street, the report said.

Brown exited the vehicle with his hands up and was arrested without incident. Boggs exited the passenger side and police arrested him without incident.

Officers found a gun case and two empty magazines in on the floor of the truck, according to the report.

Boggs eventually told police he threw the gun out of the window near the north band of Barbara Street, the report said.

Officers went to the area in the 1000 block of Barbara Street and the gun was located with the help of a Lorain Police Department K-9.

The gun was a fullyloade­d .38-caliber six-shot revolver, the report said.

The firearm was found to be reported stolen by the Parma Heights Police Department.

The two suspects were taken to Lorain County Jail.

Boggs will remain jailed until his appearance before Elyria Municipal Judge Gary C. Bennett at 9 a.m. Jan. 16. Brown is out on bond and has a preliminar­y hearing at 2 p.m. Jan. 18 before Municipal Judge Lisa A. Locke.
