Lorain City Council generally approves its rules at the start of the term, but may amend them by a vote at any time.
For Council members’ conduct, Council has Rule 40, requiring members to adhere to Robert’s Rules of Order for procedures to conduct the meetings.
Rule 41 governs conduct of the members and dress code.
Generally, they “shall conduct themselves with decorum at all times while in the confines of the Council Chamber.”
Their dress code is business attire, not jeans, work uniforms or athletic gear.
Violations of those rules could result in verbal warnings, expulsion from meetings or a 1/12 reduction of the annual pay of the offending member.
Proposed rules
The revised rule explicitly would state Council members must adhere to all federal, state and local laws.
They also would have to follow city personnel policies, including rules against discrimination and sexual harassment.
If a possible violation occurs, the legislation outlines a process for two Council members to file a complaint.
An ad hoc committee would examine the circumstances to see if Council would need a censure hearing.
The hearing would take place within 30 days of the committee findings and the alleged violator would have an opportunity to be heard.
If Council votes to censure a member, the motion would need at least six votes to pass. The alleged violator would not be allowed to take part in deliberations.
The legislation notes censure would “not follow an occasional error in judgment, which occurs in good faith and is unintentional.”
