North Ridgeville day care center sued

A North Ridgeville day care center is being sued by the family of one of its former students claiming the boy was assaulted by one of its employees.

The suit was filed July 31 in Lorain County Common Pleas Court on behalf of the boy’s parents — one from Kent and the other from Lyndhurst — and names Kiddie Kollege Inc., Michael Moell, Joann Moell and Emily Schuster as defendants.

According to the filing, on Jan. 30, 2015, the boy was assaulted by Schuster while he was being cared for at the company’s North Ridgeville facility. 33169 Center Ridge Road.

The filing claims owners of the facility knew of the assault as the parents took their son to the hospital later that day where he was treated for a broken arm and other injuries.

The defendants did not report the assault to anyone outside of the facility despite such action being required by law, the filing says.

The suit names eight causes of action related to various acts of negligence and malicious conduct on the part of the defendants.

The family is seeking an undisclose­d amount greater than $25,000 from each of the defendants in the case.

The filing also requests a jury trial before Common Pleas Judge D. Chris Cook.

A representa­tive from Kiddie Kollege Inc. sent The Morning Journal an emailed statement regarding the allegation­s.

“Kiddie Kollege has been in business since 1975 and is proud of its reputation for providing quality care to many families,” the statement says. “Kiddie Kollege is not certain of allegation­s at this time, and reserves further comment.”
