Deliberations begin in murder case
Both sides spoke for over two and half hours during closing arguments of the Abline Cannon murder trial.
A Lorain County jury that deliberated 10 hours over two days will return Aug. 29 to determine the fate of a Cleveland drug dealer charged with murdering a Lorain man.
Jurors will resume deliberating in the trial of Abline Cannon, 38.
Cannon is charged with aggravated murder, two counts of murder, one count of kidnapping, two counts of aggravated robbery, two counts of aggravated burglary, three counts of felonious assault, a single count of tampering with evidence and two counts of having weapons under disability in connection to the Dec. 10, 2016, shooting death of 23-year-old David Barreiro in his Lorain apartment.
Throughout the five-day trial, the prosecution has argued Cannon along with at least one other accomplice kicked in the door of David Barreiro’s Shore Drive apartment just before 3 a.m. in an effort to rob Barreiro, who also sold drugs.
Upon their entry, Cannon and his accomplice discovered David Barreiro’s twin brother, Daniel Barreiro, who was sleeping on his brother’s couch.
Either Cannon, or his accomplice, held Daniel Barreiro at gunpoint while the other searched the home for money, prosecutors have said.
This led to a shootout between Cannon and his accomplice against David Barreiro, who had been sleeping in a back bedroom, authorities said.
When the smoke cleared, David Barreiro was dead and he had four bullet wounds.
Cannon was struck with a bullet in his right arm. He and his accomplice fled the scene, according to prosecutors.
Defense attorney James Burge said the robbery attempt was not perpetrated by his client.
Burge said Cannon and an accomplice, who has not been charged, went to the apartment to sell the Barreiro brothers two ounces of heroin.
While they were dealing with Daniel Barreiro, Cannon and Burge claimed two uncharged accomplices who were waiting in the car, kicked in the door and attempted to rob the Barreiro brothers.
Burge claims one of the accomplices shot Cannon and David Barreiro.
Common Pleas Judge D. Chris Cook is presiding over the trial.
