Man chased, hit with stun gun

- Staff report By state law, the number on the petition must match the resolution number exactly and the Ohio Supreme Court has ruled the statute must be strictly upheld, Innes said.

A man was arrested after a foot pursuit in Vermilion that ended in him getting hit with a stun gun.

Officers were dispatched at 6:40 p.m. Nov. 20 to the 1000 block of Shawnee Court for a report of an overdosing male, according to a Vermilion police report.

An officer arrived on scene meeting with the caller who is also the grandmother of the subject. The woman said her grandson, a 31-year-old man from Delray Beach Fla., had taken heroin and was suffering from an overdose.

The officer was led to the subject who was alert and conscious but appeared to have an altered status. The officer collected the substance the subject took to be analyzed later.

While attempting to call for more units, the officer was shoved by the subject and a foot chase ensued as the subject took off running out of the front door, the release said.

The man fell after a short that is just a date and the date of the resolution is actually 9-9-18. So, it appears pretty clearly that the number they have on the petition does not correspond with the number of the resolution.”

By state law, the number on the petition must match the resolution number exactly and the Ohio Supreme Court has ruled the statute must be strictly upheld, Innes said.

He recommended denial of the petition.

Lorain County Board of Elections Director Paul Adams said his staff had checked the petitions that were turned in and there were 139 valid signatures, four invalid signatures, and the required number of valid signatures to get on the ballot was 126.

Also, during the elections board meeting, members scheduled this year’s statemandated audit. time and the officer was able to get on top of him. The officer told the man to not resist but he continued which led to the officer discharging his stun gun.

After being stunned, the man was arrested and taken to Mercy Health for an evaluation and later to Lorain County Jail, the report said.

He was charged with resisting arrest, a second-degree misdemeanor, and disorderly conduct intoxicated, a fourth-degree misdemeanor.

Adams said the audits have been performed after each presidential and gubernatorial elections for about the past 10 years, and that five percent of the votes cast in the county must be audited.

The elections board chose to audit by polling place count Dec. 6 unless the state requests a recount in a state-wide race, he said.

If one is requested, the audit will take place immediately after the recount, Adams said.

The state is requiring audits of the governor’s race and the state treasurer race.

The elections board chose the Lorain County Common Pleas Court General Division Judge race between Judge John R. Miraldi and Jenifer Berki Merril.

In other news, the elections board certified the results of the Nov. 6 general election without comment.
