Lots on the property would have on average about 50 feet of frontage and 120 feet of depth, according to the minutes of
the Sept. 25 meeting of the township’s trustees.
The zoning change was accepted by the trustees Sept. 9.
A protest against the petition was filed Nov. 13 by attorney Christopher G. Mulvaney, of Triglio, Stephenson & Dattilo PLL out NOW ISSUED AT
of Lorain, on behalf of Amherst Hampshire Farms LLC, which is the developer behind the proposed subdivision, as well as Ronald D. Yacobozzi and Remi B. Cerrone.
The protest gives two reasons why the petition should be rejected.
First, it failed to identify the number and full and correct title of the resolution; and that the petitioners’ brief summary of the amendment was misleading, inaccurate and contained material omissions.
Gerald Innes, a Lorain County assistant prosecutor and counsel for the township, was present at the Nov. 26 elections board meeting and said he disagreed that the summary didn’t adequately describe the resolution, but found the title and number issues were valid.
“It does not appear the language accurately reflects the title,” Innes said. “More clear is the fact that the only number on the petition is that the application was filed on 6-8-18.
