Man waives right to speedy trial

Driver accused in fatal crash was allegedly on the wrong side of the road

The man accused of causing a wrong way crash that killed a Euclid woman has waived his right to a speedy trial, court records show.

Donnell Ferguson, 24, was arraigned in Willoughby Municipal Court on a third-degree felony reckless homicide charge following the May 12 crash in Willoughby Hills.

According to Willoughby Hills police, the crash occurred around 3:15 a.m. on the Interstate 271 northbound bridge to Interstate 90 westbound. Ferguson was allegedly the driver of a 2013 dark gray Nissan Altima sedan that struck a 2016 white Mazda CX-5 SUV. The crash killed 32-year-old Skye Brown who was a passenger in the Mazda.

The Mazda was occupied by Brown and two other adult females, ages 56 and 39, and two children ages 9 and 11, all from Euclid. The other adult occupants of the Mazda SUV were transporte­d to Hillcrest Hospital in Mayfield Heights. The children were later taken to Rainbow Babies & Children’s Hospital in Cleveland, police said.

Ferguson also sustained injuries in the crash and was charged after being released

from a rehabilita­tion center in Lorain County.

His injuries from the crash were noticeable at a June 5 hearing in the municipal court where his case was bound over to the Lake County Grand Jury. Ferguson entered the courtroom with the assistance of a walker and had an eye patch over his left eye. His attorney said his injuries in the crash included a fractured knee cap and fractured skull.

He was out of jail at that time on a personal bond. Willoughby Hills Prosecutor Michael Germano said at the June 5 hearing the

Lake County Jail was unable to house Ferguson because of the injuries he sustained in the crash.

Willoughby Municipal Court Judge Marissa Cornachio continued Ferguson’s bond, but added conditions including that he must wear an alcohol-monitoring bracelet.

Ferguson violated that condition, according to court records, and his bond was revoked. He has been in the Lake County Jail since July 9. Court records initially listed Ferguson residing in Cleveland, but now show a Warrensvil­le Heights address.
