Q:I was involved in a high-speed rearend collision six months ago and my life has not been the same since. I am having memory problems and difficulty with my work as an accountant. The other party’s insurance adjuster offered a settlement that does not even cover my expenses and says I suffered a minor whiplash injury. What are my options?
A:While the majority of minor whiplash injures may cause symptoms for approximately three months, more severe cases may involve traumatic brain injury (“TBI”) and lifelong consequences for the victim. The violent collision of the brain against the skull during whiplash can lead to brain injury. Those afflicted may experience memory problems; forgetfulness; inability to concentrate; mood swings; irritability; depression and anxiety; and/or sensitivity to light, sounds, smells or other sensations. Unlike injuries that cause bleeding or are otherwise obvious, a non-penetrating head injury causes symptoms that may go unnoticed. Without a proper diagnosis, the brain injury may go untreated, leading to long-term damage and injury. Whiplash is a common injury in rear-end collisions. It is an extension-flexion injury affecting the soft-tissue of the neck. It can also injure your spine, ligaments, joints, muscles, nerves and brain. In such a collision, the person in the front vehicle will first have their head and neck flung forward (flexion), then propelled backward (extension), and then bounced forward again. This whiplash motion can cause significant trauma. About two million people each year in the U.S. suffer whiplash injuries. Expenses incurred from such injuries may include medical bills, lost wages, rehabilitative care, emergency room and surgical fees. On top of economic costs, you may also experience pain, suffering and a diminished quality of life. You need to be evaluated by a brain injury physician with whom you can work to attempt a full recovery from your symptoms. If you are diagnosed with a TBI, you may benefit form specialized treatment.
