Running back Joe Mixon is being sued for negligence, willful and wanton misconduct, and intentional infliction of emotional distress two years after striking Amelia Molitor at a Norman cafe.

Sooner running back Joe Mixon has been sued — two years after striking a female student in the face during a late-night confrontation at a Norman cafe.

Amelia Molitor sued Friday in federal court in Northern California, where Mixon is from. She is alleging negligence, willful and wanton misconduct, and intentional infliction of emotional distress.

She suffered fractured bones to her face from the July 25, 2014, incident at Pickleman’s Gourmet Cafe. She is seeking compensation for her medical expenses and compensation for “severe anxiety, embarrassment, depression, humiliation and emotional distress.” She also is seeking punitive damages.

The six-page lawsuit does not specify a figure.

Mixon is the only defendant. Any judgment against him likely would not be collected until after he turns pro.

Molitor, 22, will graduate from the University of Oklahoma in December. She told The Oklahoman this month the incident “broke my heart. Irreparable damage has been done.”

She said she no longer attends Sooner football games.

“I refuse to attend a game with him on the field. Which sucks. It used to take a lot to miss a game. It was the highlight of my week,” she said.

Mixon, 20, was suspended from the football team for a season after the confrontation and charged with a misdemeanor. Under a plea deal, he was put on probation for a year and required to complete 100 hours of community service and undergo cognitive behavior counseling.

He entered an Alford plea to the criminal charge. That kind of plea allowed him to accept the plea deal while continuing to assert innocence. Mixon has never discussed the incident with the media in any detail, at the advice of his attorney, because of the expected lawsuit.

Despite his plea, it is not in dispute that Mixon hit Molitor. A surveillance video shows the confrontation clearly.

The Oklahoma Association of Broadcasters is seeking in court to have that video made public. Molitor opposes its release. About 40 members of the media saw the video in September 2014.
