15-year-old charged in juvenile shooting

A 15-year-old boy has been arrested and charged with shooting another juvenile in the head.

Diego B. Ginez, of Oklahoma City, has been charged as a youthful offender in Oklahoma County District Court on counts of assault and battery with a deadly weapon and possession of a firearm.

Police reported a boy was on life support after being shot once in the head with a .25-caliber pistol on March 1. The shooting resulted from an argument between the two boys at 908 SE 67, according to a court affidavit.

The shooter fled the residence and hid the gun in a storm shelter a block south of the shooting scene at 901 SE 68, police said.

The victim was taken to OU Medical Center in critical condition. He remained on life support weeks after the shooting, according to a search warrant affidavit.

In an interview with investigat­ors, Ginez said someone grabbed the gun, causing it to discharge accidental­ly, police reported. Witnesses at the scene, though, denied anyone grabbing the pistol, according to the affidavit.

He was prohibited from possessing a gun after he was adjudicate­d Nov. 8, 2017, for a juvenile charge of second-degree burglary. Ginez said he found the gun at Interstate 240 and South Walker Avenue, according to the affidavit.

He remained in custody at the Oklahoma County jail.
