Man who dared deputies to shoot gets 10 months’ jail

A man who told deputies they would have to shoot him to get him to leave a Boca Raton-area grocery store parking lot before he punched and kicked three of them was sentenced Tuesday to 10 months in jail and four years of probation.

Palm Beach County Circuit Judge Glenn Kelley accepted Noiman’s guilty plea Tuesday on three counts of battery on a law enforcemen­t officer and a single charge of resist- ing arrest with violence, but agreed to withhold a finding of guilt so that Noiman will not be a convicted felon.

Kelley also ordered as part of Noiman’s sentence that he be released to a dual diagnosis treatment center after his jail sentence.

According to arrest reports, an assistant manager at the Western Beef market in the Sandalfoot Cove plaza west of Boca Raton called deputies on the Saturday after Thanksgivi­ng to complain that Noiman was in front of the store cursing, playing loud music and refusing to leave. When deputies arrived and asked him to leave, they said he “became more agitated, stating that we would have to shoot him and he wasn’t going anywhere.”

One of the deputies Tased Noiman in a subsequent scuffle, where he punched the deputy in the face, kicked him in the stomach and caused him to break his hand.

Deputies say Noiman later kicked two other deputies in the stomach, head and face as they tried to help hospital workers restrain him.

According to court records, Noiman’s case had been on a backup trial calendar for this month, and defense attorneys said in court records as late as last week that they planned to use the deputies’ internal investigat­ion files and pictures of their injuries if the case went to trial.
