Cops: Man killed during incident

N.Y. » City police said 37-year- old Daryl Sousie, of Troy, was t he man shot and killed during a home invasion burglary and attempted robbery at 258 Remsen St. on Aug. 5.

Policesaid Wednesday that during the course of the investigat­ion it was learned that Sousie acted with at least two co- defendants in the planning and carrying out of the burglary and attempted robbery of Shawn Rogowski’s residence.

Court documents filed in City Court Aug. 8 state that police were dispatched to the location on the morning of the incident to a report of one male shot and one male with a knife. Upon arrival, officers observed Daryl Sousie on the ground not conscious but breathing with a gunshot wound to the stomach area directly in front of the residence, police said.

The court documents say John Rogowski Jr. was standing approximat­ely 10 feet away from the victim and that he stated that his

son, Shawn Rogowski, had shot a male in self defense and was in the second floor apartment.

Michael Peabody, 49, of Troy, has already been located and charged with the felony of conspiracy in the fourth degree.

Police said the deceased’s brother, Andy Sousie, 31, of Troy, is currently being sought by the Cohoes police for his alleged involvemen­t in the incident.

Previous court documents relating to Rogows-

ki’s arrest state that Rogowski’s second floor apartment did have a large sumofU.S. currency, a large amount of marijuana, packaging bags, scales and other parapherna­lia consistent with dealing illegal drugs. Those court documents also stated that Rogowski admitted to police that he had a large sum of money in his residence on Remsen Street and that he made illegal drug deals the day before he shot and killed an intruder in his residence.

Rogowski had previously been charged with endangerin­g the welfare of a child, a misdemeano­r, for admitting to dischargin­g a fire-

arm in his residence during the home invasion in the direction of his live in girlfriend’s 11-month- old child, who was in a nearby bed. The charge of criminal possession of marijuana in the second degree, a class D felony, has been added to Rogowski’s charges, as police said he had over a pound of marijuana in his residence at the time of the incident.
