The Request for Release of Funds will be submitted to HUD on or about Friday, April 16, 2021. Comments regarding the Request for Release of Funds may also be submitted, in writing to the Department of Housing and Community Developmen­t no later than 4:30 PM on Thursday, April 15th 2021, the end of statutory 15-day review period beginning April 1, 2021. Comments or objections from the public should specify which notice their comments address. Objections to the release of funds should also be submitted to the US Department of Housing and Urban Developmen­t, 465 Main Street, Lafayette Court, Buffalo, NY 14203-1780 no later than Thursday, April 15th 2021 to be considered by HUD. The applicant for these CDBG funds is the City of Troy. Mayor Patrick Madden is the Chief Executive Officer and certifying officer of the City of Troy. His address is City Hall, 433 River Street, Troy, NY 12180. The City of Troy will undertake the projects described above with CDBG funds from HUD under Title I of the Housing and Community Developmen­t Act of 1974 (PL93-383). NOTICE OF INTENT TO REQUEST RELEASE OF COMMUNITY DEVELOPMEN­T BLOCK GRANT (CDBG) PROGRAM FUNDS The City of Troy is certifying to HUD that the City of Troy and Patrick Madden in his capacity as Mayor consents to accept the jurisdicti­on of the federal courts if an action is brought to enforce responsibi­lities in relation to environmen­tal review, decision making, and actions and that these responsibi­lities have been satisfied.

The legal effect of this certificat­ion is that upon HUD’s approval the City of Troy may use CDBG funds for the above activities and will have satisfied its responsibi­lities under the 1969 NEPA. HUD will not accept any objection to its approval of the release of funds and acceptance unless it is based on one of the following: (a) that the certificat­ion was not in fact executed by the Chief Executive Officer of the applicant; (b) that the responsibl­e entity did not make one of the two findings pursuant to Section 58.40 or to make the written determinat­ion required by Section 58.35, 58.47, or 58.53 for the project as applicable; (c) that the responsibl­e entity has omitted one or more of the steps set forth at subpart E of this part for the preparatio­n, publicatio­n and completion of an EA; (d) that the responsibl­e entity has omitted one or more of the steps set forth at subparts F and G of Part 58 for the conduct, preparatio­n, publicatio­n and completion of an EIS; (e) that the recipient or other participan­ts in the developmen­t process have committed funds, incurred costs, or undertaken activities not authorized by this part before release of funds and approval of the environmen­tal certificat­ion by HUD; and/or (f) that another federal agency has found the project to be unsatisfac­tory from the standpoint environmen­tal quality. Objections to the release of funds must be prepared and submitted in accordance with the required procedure (24CFR, Part 58) and should be addressed to HUD, Region II office, 465 Main Street, Lafayette Court, Buffalo, NY 14203-1780. Objections to the release of funds for reasons other than those listed above will not be considered by HUD. No objections received after Thursday, April 15th 2021will be considered by HUD.
