North Wales man convicted of domestic assault

Adam D. Kelly, 31, is due to be sentenced in March after being found guilty of July 2016 assault

A 31-yearold North Wales man is awaiting sentencing after being found guilty of several criminal counts in connection with a domestic assault involving his girlfriend and their young child in July, according to court records.

Adam D. Kelly, of the 400 block of East Montgomery Avenue, was convicted of misdemeano­r counts of simple assault and recklessly endangerin­g another person, and summary counts of harassment and driving with a suspended license, during a bench trial presided over by Montgomery County Judge Garrett Page, records show. Kelly was found not guilty of endangerin­g the welfare of children, as well as additional counts of simple assault, recklessly endangerin­g another person and harassment, records show.

Police said in a criminal complaint that on the evening of July 5, officers were dispatched to Kelly’s residence for a report of an assault that had allegedly occurred earlier in the day, and they met with Kelly’s girlfriend, who was visibly distraught and said that Kelly — who had left the home prior to the arrival of police — had hit her and their 2-year-old daughter approximat­ely two hours earlier.

The woman told cops that she and Kelly had gotten into a verbal dispute that turned physical when Kelly hit her with a pillow while she was holding her daughter, and then, after she put the little girl down, Kelly pushed the girl aside and hit the woman’s head on a table multiple times while the little girl was yelling at Kelly to stop hitting her mother, according to court documents.

During the altercatio­n, the woman told police, a candle fell off a bookshelf and struck her newborn baby, who was sitting in a nearby chair, an affidavit of probable cause states.

Police said the woman had scratches on her left arm and shoulder, and a scrape on her shin, while the 2-year-old girl had a small abrasion on her cheek. The baby had no apparent injuries from the falling candle, according to court documents.

The woman told cops that after the altercatio­n, Kelly took her phone away from her so she couldn’t call police, and that he began playing video games but wouldn’t let her leave the residence, the criminal complaint indicates. She said that she “was afraid for her life and the safety of her children when Kelly returned home,” according to the complaint.

Kelly returned to the residence a couple of hours later, at which point police arrived at the scene and took him into custody.

Kelly had also originally been charged with two counts of felony aggravated assault, but both counts were withdrawn when he agreed to waive his preliminar­y hearing in the case.

Kelly remains behind bars at Montgomery County Correction­al Facility while awaiting sentencing, which is scheduled for March 30, records indicate.
