Man again headed for trial in urination and theft case
Darrin Constable, 51, failed to complete court-ordered community service as part of diversionary sanctions, court records indicate
A 51-yearold New Hanover man who had been admitted to a Montgomery County diversionary program after being charged last year with urinating on the floor of a Towamencin restaurant because he was upset over being fired, and then sending a video of the act to his former boss, is again headed for trial in the case after he failed to appear to complete his court-ordered community service, according to court records.
Darrin Scott Constable, who was residing on the 1800 block of Little Road at the time of the incident, was charged last year with one count each of seconddegree misdemeanor criminal mischief, second-degree misdemeanor theft and summary disorderly conduct, and now has a pre-trial conference in the matter scheduled for June 13, court records indicate.
Towamencin police have said in court documents that on the afternoon of March 11, 2016, the manager of the Mainland Grille — located at 2250 Rittenhouse Road and part of the Mainland Golf Course — contacted authorities to report a vandalism incident and said that Constable, described as a “disgruntled” former employee, intentionally urinated in an upstairs ballroom and sent the manager a video of the incident.
There was also video footage of Constable throwing out expensive bottles of chemicals and detergents, documents state.
According to police, the manager subsequently contacted authorities to let them know that Constable had sent him a photo of food from the Mainland Grille that appeared to be inside Constable’s personal refrigerator, and that he had also sent “quasi-threatening text messages.”
Court documents indicate that Constable later showed up at Towamencin police headquarters and admitted to all of the allegations in a statement.
Constable, who had the three charges held for trial after a preliminary hearing in Lansdale district court last year, had been placed in the Montgomery County Accelerated Rehabilitative Disposition (ARD) diversionary program in August, but the case was moved back to a trial track after an ARD hearing report in county court earlier this month, records show.
It was not immediately clear Monday where Constable was supposed to perform his community service.
Constable has also been ordered by the court to make restitution to the victim in the amount of $1,389.67, and to pay court costs totaling $2,357.25, records indicate.
