Judge dismisses case against parolee

Robbie J. Lujan of Vacaville paid $5,000 bail following February standoff with police

A Solano County Superior Court judge has dismissed the misdemeano­r case against a 33-year-old Vacaville parolee charged in connection to an early February standoff with Vacaville police, The Reporter has learned.

Judge William J. Pendergast on April 21 dismissed the charge against Robbie Joseph Lujan after the defendant paid $5,000 bail on April 12, court records indicate.

Lujan initially was charged with two misdemeano­r counts of resisting, obstructin­g or delaying a peace officer or emergency medical technician during a Feb. 4 standoff with police.

However, court documents show the case was dismissed on a motion by Deputy District Attorney Hunter Burnette “based on admission” by Lujan that he had violated his terms of parole for a previous crime.

Pendergast reinstated Lujan’s parole terms and ordered him to serve 180 days in Solano County Jail after having served some weeks in custody, then dismissed the case and ordered Lujan to report to the County Probation Department within 24 hours of his release.

The April 12 and 21 proceeding­s occurred after Lujan failed to show for an 8:30 a.m. March 23 pretrial conference in Department 11. Pendergast subsequent­ly issued a bench warrant.

Court records show the warrant was served, then returned to court file records April 9.

The Solano County District Attorney’s complaint, filed Feb. 8, indicated that Lujan allegedly willfully obstructed officers Jesse Outly and Erik Griffieth during the standoff.

He was represente­d by Fairfield criminal defense attorney Sal Giambona.

Lujan, however, could not stay out of trouble.

Two Napa County media reports indicated Lujan was arrested at 2 a.m. Oct. 11 after a traffic stop in American Canyon.

He was taken into custody on suspicion of identity theft, being a felon in possession of a firearm and possessing a concealed firearm in a vehicle.

He was later booked into Napa County Jail, Napa police reported.

A check of Napa County Superior Court records Wednesday did not show that Lujan appeared — or had been scheduled to appear — in court in recent weeks.
