A Benton man was arrested early Thursday for allegedly beating a man who was reportedly in a relationship with his ex-girlfriend.

Benjamin Marcus Lowery, 27, who lists a River Street address, was taken into custody shortly after 3:30 a.m. Thursday and charged with a misdemeanor count of third-degree domestic battery, punishable by up to one year in jail. He remained in custody Friday in lieu of $1,000 bond and is set to appear July 10 in Gar- land County District Court.

According to the affidavit, shortly after 3 a.m. Thursday

Garland County sheriff’s Deputy

Clayton Green was dispatched to a residence on Briarcroft Drive where a disturbance had just occurred and made contact with Lowery’s ex-girlfriend, who said Lowery had entered her house uninvited. She said Lowery is a friend, and knows where a key to the residence is hidden.

She told Green she and her new boyfriend were having sexual relations when Lowery walked into the room. She said Lowery became agitated and started fighting her boyfriend. The boyfriend said Lowery began swinging at him. Green observed cuts and bruises on the boyfriend’s right arm and a bruise with swelling on his forehead.

The ex-girlfriend said Lowery had left, and she was unsure of his location. Deputy Andrew Goodman located a vehicle leaving the area and checked its license plate, which showed the car was registered to Lowery’s roommate. Goodman stopped the vehicle in the 1200 block of Airport Road and found Lowery in the vehicle’s front passenger seat.

Lowery reportedly said he had received a message from his ex-girlfriend stating that she was going to kill herself. He called Hot Springs police and said he was told they did not have time to do a welfare check on her.

Goodman radioed police dispatch, which said it had not received a call from Lowery. Lowery reportedly admitted he went inside to find his ex-girlfriend with her new boyfriend, and that he hit him several times out of anger.

Lowery allegedly told deputies it was all right if he had to go to jail for his actions.
