Lonsdale man sentenced to 15 years
A Lonsdale man arrested late last year for shooting a woman while she was standing outside his residence was sentenced to 15 years in prison Thursday after pleading guilty in Garland County
Circuit Court.
Daniel Tyler
Fisher, 27, pleaded guilty to first-degree battery, punishable by up to 20 years in prison, and was sentenced to 15 years, ordered to pay $420 in court costs and barred from any future contact with the victim in the incident.
Fisher’s attorney, Terri Harris, said in exchange for Fisher’s plea additional charges of committing a terroristic act were not pursued in
the case. She said the victim was his girlfriend at the time and “he had no idea she was standing by the car when he fired.”
Harris said that, under the law, it’s considered “transferred intent,” and even if he wasn’t shooting at her, he is still responsible.
She said the people in the car outside “had pulled a gun on Daniel the day before.” Harris noted the victim is now in a wheelchair as a result of her injuries. “It’s tragic for all concerned,” she said.
According to the probable cause affidavit, on Dec. 29, 2017, at around 3:12 a.m., Garland County sheriff’s dispatchers received a call of shots fired in the 2700 block of Highway 128 in Lonsdale with one person sustaining multiple gunshot wounds. The caller reportedly said “Tyler” was the shooter.
Deputies responded to the residence at 2798 Highway 128 and located a woman, 32, with gunshot wounds to her back. The woman was airlifted to an area hospital by LifeNet Air.
Dispatchers received a call from a neighboring family member who said Fisher was at her residence. Deputies located Fisher there and took him into custody without incident.
When questioned later by investigators, Fisher admitted to firing two to three rounds toward a black car in an attempt “to scare the individuals away.” He stated he locked the .22-caliber rifle he had fired in his gun safe in his bedroom and the keys to the safe were on top of his dresser in his closet.
Around 6:45 a.m., investigators executed a search warrant on Fisher’s residence and located a gun safe in the closet of the master bedroom and found the keys on top of a dresser in the closet just as Fisher had described. They opened the safe and recovered a .22-caliber rifle and seized it as evidence.
Investigators interviewed multiple witnesses at the scene before arresting Fisher, who was released later that day on
$5,000 bond. Fisher appeared in circuit court on April 3,
2018, and pleaded not guilty to the charge. It was later set for a disposition hearing.
