Local man asleep at Walmart arrested on drug charges

A local man on parole reportedly found passed out in his vehicle outside Walmart Monday morning was arrested on felony charges for allegedly possessing drugs.

Toby Michael Green, 60, who lists an Ira Street address, was taken into custody shortly after 8:30 a.m. outside the store, located at 1601 Albert Pike, and charged with possession of drug parapherna­lia, punishable by up to 20 years in prison, and possession of a schedule III controlled substance, punishable by up to six years.

Green remained in custody Tuesday in lieu of

$7,500 bond and is set to appear today in Garland County District Court. He had previously pleaded guilty Feb. 5 to a felony charge of theft of property and was sentenced to four years in prison.

According to the probable cause affidavit, shortly after 8 a.m. Monday, Hot Springs police Officers Jason Greene and Brandon McAdoo were on routine patrol when they saw a white

2007 Mazda M6 parked in the grocery side handicappe­d section of Walmart and found the sole occupant, later identified as Green, unresponsi­ve in the driver’s seat with a jacket over his head and the window open.

They noted the music was playing at such “an extremely loud level” it could be heard inside the store. Officers removed the keys and turned the music off and tried to find out why

Green was sleeping in the parking lot.

Green was reportedly “extremely lethargic, had slurred speech and difficulty answering questions.” He claimed he didn’t know who the vehicle belonged to, how long he had been at Walmart or where he lived. A computer check revealed his probatione­r under active supervisio­n with a search waiver on file.

Green and the vehicle was searched and officers found a baggie with white powder residue which Green allegedly admitted was meth, but claimed he had not used any in two days. In the center console, they located seven Suboxone sublingual films, 5.9 grams total, which is classified as class III controlled substance.
