Driver arrested for endangering minors, DWI after two children found in vehicle
A Royal man was arrested on multiple charges after he was allegedly driving while intoxicated with two small children in his vehicle Sunday morning.
Spencer Stonewall Jackson Dalrymple, 43, who lists a North Crystal Springs Road address, was taken into custody shortly before noon and charged with two counts of third-degree endangering the welfare of a minor and driving while intoxicated, first offense, both misdemeanors, and cited for driving on a suspended license, no registration, speeding and no proof of insurance.
Dalrymple, who also had two warrants for failure to appear, was later released on $4,500 bond and is set to appear Jan. 7 in Garland County District Court.
According to the probable cause affidavit, Arkansas State Police Cpl. Michael Reed was patrolling eastbound on Highway 270 west near Crystal Springs when he saw a silver 2007 Toyota Tundra coming up behind him at a high rate of speed and clocked it doing 75 mph in a 55 mph zone.
Reed pulled onto the shoulder to allow the vehicle to pass him and then made a traffic stop on it near Ragweed Valley Road and made contact with the driver, identified as Dalrymple, and noted there were two children, both age 7, in the back seat.
Reed said he could smell a strong odor of intoxicants coming from the vehicle so he asked Dalrymple to get out and noted he was unsteady on his feet as he walked to the rear of the vehicle.
Asked if he had been drinking any alcohol, Dalrymple allegedly stated he had “a shot” about 30 minutes earlier. Reed then asked if he had drank any the night before and he stated he had late Saturday night. Dalrymple submitted to a breathalyzer test which he reportedly failed so he was taken into custody.
Dalrymple’s wife came to the scene and took custody of the two children and Dalrymple was taken to the detention center where he reportedly refused to take a second breathalyzer test. Due to his disabilities, Dalrymple said he didn’t feel comfortable doing any field sobriety tests.
Dalrymple allegedly stated his attorney “would not be happy if he performed any tests.”
