Murder victim talked to 911 as he was shot, affidavit says

The victim of a fatal shooting Monday morning had called 911 for help and was on the phone with dispatcher­s while still being shot, according to an affidavit released Tuesday.

Larry Johnson, 61, of Hot Springs, was reportedly shot and killed at his workshop, located at 360 Westinghou­se Drive, shortly

after 9:30 a.m. Monday.

Calvin Tyrone Davis, 44, who lists a Chelsea Street address, was taken into custody at the scene shortly before 1 p.m. Monday and charged with first-degree murder, punishable by up to life in prison, for the death of Johnson.

Davis, who also had warrants for failure to pay and failure to comply, remained in custody Tuesday on zero bond and is set to appear today in Garland County District Court.

According to the probable cause affidavit, around 9:40 a.m. Tuesday, the Garland County Communicat­ions Center received a 911 call from a man who at one point identified himself as Larry and told dispatcher­s he had been shot by an unknown black male on his property at 360 Westinghou­se.

While dispatcher­s were attempting to gain more informatio­n, they heard additional gunshots in the background.

Garrett responded to the scene with multiple units and as he turned into the driveway he made contact with an elderly white male at the top of the driveway. While talking to him and confirming the location of house number 360, Garrett heard what sounded like gunshots.

He approached the area of the house and saw a black male, later identified as Davis, walking down the driveway away from the area where the gunshots were heard. Davis was detained without incident at that time.

Other units arrived and they located Johnson deceased inside the large workshop on the property, the affidavit states.

Garrett noted after identifyin­g Davis he continuous­ly asked him if he was OK. While the deputy was checking on him, Davis allegedly stated,

“Someone said they found a gun and my fingerprin­ts will be on that gun because I had that gun from three days ago.”

Davis was taken to the sheriff’s department and interviewe­d by Investigat­or John Greathouse after being read his Miranda rights. During the interview, Davis allegedly made a statement admitting that he shot Johnson.

The affidavit did not indicate a motive for the shooting.

The warrants for failure to pay and failure to comply stemmed from his arrest on April 3, 2017, for driving while intoxicate­d, first offense, for which he was sentenced to six months’ probation, and ordered to pay $995 in fines and court costs. He reportedly failed to report for probation and failed to make his fine and court payments.
