Man charged with felony battery after alleged attack on girlfriend

A Mountain Pine man was arrested on a felony battery charge after allegedly attacking his girlfriend late Wednesday.

Kyle E. Hurst, 49, of 2322 W. Glazypeau Road, was taken into custody at his residence shortly after 8:30 p.m. and charged with second-degree domestic battery, punishable by up to 10 years in prison.

Hurst, who lists no prior criminal history, remained in custody Thursday on zero bond and is set to appear today in Garland County District Court.

According to the probable cause affidavit, around 8:15 p.m., Garland County sheriff’s Deputy Shane Tatum was dispatched to the residence regarding a disturbanc­e and was told a woman was in the yard “unconsciou­s and bleeding from the mouth” and there was a man standing in the yard with a baseball bat.

When he arrived, Tatum found the woman, 43, standing in the yard and confirmed she had blood on her mouth. He asked her where the man who did that to her was and she said he went into the house.

As Tatum approached the house, Hurst came out and the woman reportedly identified him as the one who had attacked her. Tatum took Hurst into custody at that point without incident and went back to talk to the woman who was being treated by LifeNet personnel.

She reportedly stated she could not “remember a lot,” but that Hurst had slapped her twice and then put his hand around her throat and choked her until she passed out. Tatum noted she had red marks around her throat and mouth.

The woman reportedly declined to be transporte­d to a hospital and confirmed she and Hurst were “in a relationsh­ip.” Tatum noted that both Hurst and the woman were “extremely intoxicate­d.”
