Teen charged with felony battery, assault for alleged attack on mother, another teen
A local teen was arrested Sunday morning on felony and misdemeanor charges after allegedly injuring his mother and a 19-year-old male at his residence during an altercation between them.
Elijah Seth Estorga, 18, of 429 Alcorn St., was taken into custody shortly before 10:30 a.m. and charged with a felony count of second-degree battery, punishable by up to six years in prison, and a misdemeanor count of third-degree domestic battery, punishable by up to one year in jail.
Estorga was held overnight on zero bond and was set to appear Monday in Garland County
District Court.
According to the probable cause affidavit, shortly after 9:30 a.m. Sunday, Hot Springs police responded to a disturbance call at Estorga’s Alcorn Street residence and upon arrival spoke to Estorga’s mother, Mariah Marshall, and two witnesses including the mother’s other juvenile son.
Marshall stated there was a fight between her and Estorga on Saturday and due to his actions he was removed from the residence and told not to return. On Sunday morning, she said she woke up and discovered Estorga was inside the residence and the two got into an argument.
She said Estorga became irate at one point and slapped her in the face. At that point, her other son and a friend, Carter Chapmand, 19, got in between Estorga and her. As her other son attempted to get her away, Estorga allegedly began punching her in the face with both fists.
At that point, the other son and Chapmand took Estorga to the floor in the hallway. Estorga then allegedly punched Chapmand in the face several times and then grabbed a porcelain duck and hit him in the back with it. Estorga then began punching glass picture frames, causing the glass to shatter.
Estorga allegedly followed Marshall to her bedroom and threw a piece of glass at her, causing a laceration to her right arm. The other son was able to grab Estorga again and take him to the floor, getting him away from Marshall.
Before officers arrived, Estorga was able to get loose and flee the scene. A short time later, officers located him in the 2300 block of Central Avenue and took him into custody. He was transported by LifeNet to an area hospital for treatment of a cut on his knee from the incident.
Officers made contact with Chapmand, who stated Estorga had punched him in the face and then struck him in the face with a decorative glass swan. The affidavit notes Marshall had swelling to both eyes and redness to her face while Chapmand sustained fractures to his nasal bones. Both of his eyes were also swollen and he had a laceration to his nose.
When questioned at the detention center, Estorga reportedly admitted to punching Chapmand in the face.
According to court records, Estorga was previously arrested Jan. 5 on a felony charge of breaking or entering. He pleaded not guilty in Garland County Circuit Court on Feb. 21 and was released on a $1,500 bond on May 9. He is set for a disposition hearing on the charge, punishable by up to six years in prison, on Aug. 3.
