Man arrested for alleged felony battery of 12-year-old daughter

A Pearcy man was arrested on felony and misdemeano­r battery charges Sunday after allegedly attacking his 12-yearold daughter and her mother at their residence.

Terry Wayne Wilson, 53, of 120 Caraway St., was taken into custody at the residence shortly before 2 p.m. and charged with one felony count of second-degree domestic battery, punishable by up to 10 years in prison, and a misdemeano­r count of third-degree domestic battery, punishable by up to one year in jail.

Wilson was held overnight on zero bond and was set to appear Monday in Garland County District Court.

According to the probable cause affidavit, Garland County sheriff’s Deputies Candice Presley and Stacy Morgan were dispatched to the residence regarding a battery that had already occurred. Presley was attempting to locate the house when a woman pulled up beside her in an SUV who was crying and stated, “Please make him leave.”

The woman, 53, stated her boyfriend, identified as Wilson, had been hitting her and their daughter, 12, and would not let them leave the house. Presley went to the house and made contact with Wilson who stated his girlfriend had “been drinking all day” and hit him and bit him on the finger. Wilson reportedly refused any medical treatment or to press charges.

Presley asked about the daughter and Wilson stated she was in her room. Presley went inside and talked to the daughter who alleged her father had hit her several times and choked her. She said he snatched her phone out of her hand at one point, jamming her finger.

Morgan arrived at that point and he spoke to the daughter and the mother who had pulled into the driveway. Both the girlfriend and daughter indicated they wanted to press charges.

When told he was being arrested for battery, Wilson told the deputies he had video of the incident on his phone. Presley watched the video he had and noted “it showed Mr. Wilson being the aggressor and not allowing (the victims) to leave.”

Wilson’s phone was seized as evidence for the video he had and he was taken into custody without further incident.

According to court records, the girlfriend had filed a petition for an order of protection from Wilson in Garland County Circuit Court on Aug. 26 alleging he had been beating her. She noted “he gets so out of control he breaks doors and windows and has hit me more times than I can count” and broke her ankle 18 months earlier.

She said she “just wants him to go away and leave my daughter and I alone so we can have a normal life without all the violence. I am scared he is going to kill me one of these days.”

The petition was reportedly dismissed on Sept. 24 at the request of the petitioner. The girlfriend had previously petitioned for an order of protection from Wilson on April 8, 2016, but it was also dismissed at her request on May 4, 2016.
