Two local men arrested on felony drug charges in separate incidents

Two local men were arrested on felony drug charges within an hour of each other Wednesday afternoon in separate incidents involving suspicious behavior and a break-in.

Ryan Dale Magby, 29, who lists a Chelle Street address, was taken into custody around 3:45 p.m. and charged with possession of a controlled substance, meth, and possession of drug parapherna­lia, each punishable by up to six years in prison.

Magby remained in custody Thursday in lieu of a $5,000 bond and is set to appear today in Garland County District Court. According to court records, he was convicted of a felony count of breaking or entering on July 6, 2020, and sentenced to six years’ supervised probation.

According to the probable cause affidavit, shortly before 3:30 p.m., Hot Springs police responded to the area of Winans and Shawn streets regarding a suspicious white male.

A 911 caller said the male had just run out of the woods in front of their vehicle and gave a descriptio­n. Officer 1st Class Jonathan Israel spotted a man, later identified as Magby, matching the man’s descrip- tion at the intersecti­on of Saint Charles Circle and Shady Grove Road.

A computer check showed Magby was on probation with a search waiver on file and Israel allegedly located a small baggie with 0.5 gram of what later tested for meth, a straw, a lighter and burnt foil inside a purse in Magby’s backpack so he was taken into custody.

Brian K. Briggs, 55, who lists a Rockdale Road address, was taken into custody shortly before 4:30 p.m. and charged with a felony count of possession of a controlled substance, meth, with purpose to deliver, punishable by up to six years in prison, and a misdemeano­r count of possession of drug parapherna­lia, punishable by up to one year in jail.

Briggs, who also had three warrants for misdemeano­r failure to appear, remained in custody Thursday in lieu of a $6,500 bond and is set to appear today in district court. He lists no prior felony history.

According to the probable cause affidavit, HSPD Cpl. Taylor Gates responded to a breaking or entering in progress in the 1800 block of Higdon Ferry Road. Other officers already had two suspects, including one identified as Briggs, detained at the scene.

After determinin­g Briggs had multiple warrants, he was taken into custody and in searching his person, a glass pipe with white and brown residue was allegedly found in his front pocket. In the same pocket, a clear bag was also found that reportedly contained 1.4 grams of what later tested positive for meth, resulting in the felony charge.
