HS man arrested on warrants from alleged break-in, attack on brother

A Hot Springs man was arrested Tuesday on multiple felony and misdemeano­r warrants stemming from allegation­s he broke into a residence last week, tried to take his child and attacked his brother.

Darell Kavon Smith, 26, who lists a Main Street address, was taken into custody shortly before 3 p.m. at CHI St. Vincent Hot Springs after his release from the hospital following treatment of injuries he suffered during the alleged incident on April 22. The arrest affidavits did not indicate the nature of his injuries.

Smith was charged with felony counts of breaking or entering and theft of property, each punishable by up to six years in prison, and misdemeano­r charges of criminal attempt to commit breaking or entering, third-degree domestic battery, possession of a controlled substance and three counts of violating a no-contact order.

Smith was later released on a $17,500 bond and is set to appear on June 7 in Garland County District Court.

According to court records, he lists no prior felony history, but pleaded no contest in

2019 to misdemeano­r charges of ter- roristic threatenin­g and resisting arrest and was sentenced to 15 days in jail, and has misdemeano­r counts of terroristi­c threatenin­g, third-degree domestic battery and third-degree assault pending from arrests in November 2023.

According to the probable cause affidavits, on Nov. 27, 2023, a court order was issued out of district court barring Smith from contact with the residents of a house in the 100 block of Catherine Heights Loop.

Smith allegedly went to the residence shortly before 7 p.m. on April 21 and threatened people there with a firearm and then returned shortly after 6:30 a.m. on April 22 and allegedly broke into a bedroom window, fleeing before Hot Springs police arrived each time.

On April 22, shortly before 9 a.m., police got a phone call from Smith’s mother stating he was headed to the Catherine Heights residence again and officers responded to the scene minutes later.

On arrival, they located Smith with “an apparent injury,” and while rendering aid to him officers allegedly found he had two clear containers with 46 blue pills, later identified as alprazolam, a schedule IV controlled substance, and $192 in cash in his possession.

Smith’s brother told police he was inside the residence that morning when Smith came to the property and punched him in the face several times while trying to get in the front door. He said he told Smith several times “you’re not coming inside,” and Smith argued, “No, I’m going in.”

Officers noted the brother had “red discolorat­ion” and bruising to his face which corroborat­ed his statement and witnesses at the scene also provided corroborat­ing statements.

Police later learned during Smith’s first visit around 6:30 a.m. that Smith had allegedly used an ax to break into the window of a female resident’s bedroom where she and her 3-year-old son were sleeping. She noted they were under the window and Smith came in and attempted to take “their son.”

She said she was holding their son in her arms and refused to give him to Smith, prompting him to take her cellphone, valued at $1,200, and flee the scene while she was calling 911. Smith’s brother was inside at the time and told police he woke up to “loud yelling” and then saw his brother flee the scene.

After Smith was detained by the police, the woman was able to retrieve her cellphone from Smith’s mother before he was taken to the hospital.

After his arrest and being read his rights, Smith reportedly admitted to breaking the bedroom window the morning of April 22, noting he used “a splitting ax” so he could enter the property.

Smith said he was trying to get property from inside the residence and also allegedly admitted to coming back a few hours later and “trying to push past his brother” in order to get inside.

Warrants for Smith’s arrest on the various charges were obtained the next day on April 23.
