Racist items will stay jailed
LAFAYETTE >> A man accused of keeping a large weapons cache at his northwestern New Jersey home will remain jailed.
A federal judge made the decision Thursday, agreeing with prosecutors that 57-year-old Joseph Rubino could pose a danger to the community.
His attorney, Dan Marchese, argued that prosecutors had sensationalized their findings in order to paint Rubino as a potentially violent, white supremacist.
State police say they found numerous weapons and ammunition inside Rubino’s vehicle after it crashed July
24. They later executed search warrants on the vehicle and at Rubino’s Lafayette Township home.
Authorities say numerous guns were found in the home — including rifles, shotguns and handguns
— along with high-capacity magazines, ammunition, a grenade launcher and other related items. Officers also allegedly found methamphetamine, marijuana and white supremacist literature..
City police found the three men when they responded to reports of shots fired. All three were taken to a hospital, but 25-yearold Xavier McCray was pronounced dead there a short time later.
A 19-year-old Paterson man was treated for undisclosed injuries and was later released. But a 38-yearold Jersey City man remained hospitalized Friday in stable condition.
A motive for the shooting remains under investigation.
The names of the two wounded men and further details on the shooting were not disclosed.
Authorities have said Ellery was working the overnight shift in the Somerset County community when he stopped responding to radio transmissions. An officer dispatched to locate him found Ellery’s patrol car in the driveway of a business.
