Aubrey waits for hospital transport

A man found not guilty by reason of insanity for a 2018 Hoopa homicide is still awaiting transport to a state hospital.

In August, Antone Aubrey, 33, was convicted of charges related to the fatal shooting of his 33-yearold sister Angel Aubrey on Feb. 17, 2018, but found not guilty by reason of insanity after three experts testified Aubrey suffered from schizophre­nia. Paula Riese, a representa­tive of the state Department of State Hospitals, said Aubrey is now No. 7 on the waitlist to be transporte­d to the Napa State Hospital.

“I don’t have an estimated date of admission,” Riese said. ” … It’s not likely he’ll be admitted within a month. That has been my personal experience on this matter, but things can change.”

Attorney Sara Zalkin, who was appearing on behalf of defense attorney Russell Clanton, asked Judge Lawrence Killoran to hold the Department of State Hospitals in contempt since he was No. 13 on the waitlist 60 days ago.

“On behalf of Mr. Clanton, he believed that it is inhumane to keep Mr. Aubrey in this custodial setting when there has been a judicial finding of the need for mental health treatment,” Zalkin said.

Killoran denied that request.

“Everyone is dealing with the COVID emergencie­s and it is not without their best efforts that we continue to have these difficulti­es,” Killoran said. “I wouldn’t find it willful in any event.”

The next confirmati­on of transport is set for Jan. 20.
