Green could be out of detention

Anita Green, the mother of the woman accused of murdering her estranged husband, herself accused of being an accessory to that murder, could be out of jail soon.

Green appeared in federal court in Toledo Thursday with her Attorneys William Kluge and Zachary Maisch for a detention hearing.

She is accused of offering assistance to her daughter, Amanda Hovanec and Anthony Theodorou after Hovanec allegedly injected her estranged husband with etorphine, which caused his death.

Both federal prosecutor­s and Green provided evidence to the court. Additional testimony was received from FBI Special Agent Andrew Eilerman, who helped investigat­e the case, and a proposed custodian, Diane Lynn Fahncke.

According to court records, Green will be released on a $100,000 secured property bond with terms and conditions as stated on the record.

Federal prosecutor­s moved for a stay of the release order, which was granted pending a review by Auglaize County Municipal Court officials. The defendants had been

held in the county court immediatel­y after their arrest and each had been ordered held on a $2,000,000 bond with a 10 percent privilege.

The other defendants in the case, Hovanec and Theodorou are charged with conspiracy to import a controlled substance, importatio­n of a controlled substance, conspiracy to possess with intent to distribute a controlled substance, and distributi­on of a controlled substance. Each of the five counts against defendants Hovanec and Theodorou carries a sentencing penalty enhancemen­t due to the death of an individual as a result of the use of the controlled substance, according to the indictment.

They are both set for a pretrial conference July 8, after pleading not guilty earlier this month.
