Sentencing for man who robbed restaurant delayed

Thursday’s sentencing for the man who robbed a Yuma restaurant did not take place and has been delayed until later this month while a report the judge requested is prepared.

According to court records, attorney Michael Donovan, who represents Ricky David Spencer, filed a written request on Oct. 24, asking for a 30-day continuanc­e.

The reason he gave was that the Yuma County Adult Probation Department needs enough time to write a presentenc­e Report (PSR) on his client.

A (PSR) is a report prepared by a probation officer, at the request of the judge, after a defendant has either pleaded guilty or been found guilty of a criminal offence.

The purpose of a (PSR) is to assist the judge in determinin­g the most appropriat­e sentence, by providing him or her with any informatio­n about whether there are any aggravatin­g factors, which could be used to increase the harshness of the sentence, or mitigating factors, which could be used to lessen the severity of a sentence.

Spencer, who remains in custody on $100,000 bond, was arrested in the Dec. 28 armed robbery of the Del Pueblo Birrieria 1225 W. 8th St.

Superior Court judge Roger Nelson, who is presiding over the case, filed a written response granting the request. Sentencing for Spencer, which was originally set for 8:30 a.m., has been reschedule­d for 8:30 a.m. on Nov. 30.
