Golf course eatery owner seeks to alter contract
City Council set to meet on Tuesday and Wednesday
The concessionaire operating the restaurant at Yuma’s Desert Hills Golf Course has asked for changes to the contract, including a reduction in the percentage of revenues that go to the city.
The City Council will consider the changes when the request comes up as part of the consent agenda this week. The council will meet at 6 p.m. Tuesday for a work session and 5:30 p.m. Wednesday for the regular meeting. Both meetings will be held in the City Hall Council Chambers, 1 City Plaza.
Alex Trujillo, owner of Chef Alex Group, which has been operating The Patio restaurant, has requested some relief from the 10 percent gross revenue fee provision. The original contract called for a minimum of 5 percent of gross revenue to be paid to the city, but Frank’s Family Dining of Yuma No. 2 LLC, the only respondee to the Request for Proposals, bid 10 percent of gross revenues for the concession.
Chef Alex has been operating as an assignee to Frank’s concessionaire agreement and would like to be the direct concessionaire with the name of the restaurant to be formally known as “The Patio” instead of “The Hills” as required in the current agreement.
In other action, the council will hear two presentations during the Tuesday work session. Lisa Marlin, director of financial services, will present the Online Utility software program that provides customer verification for the purpose of recommending deposit and collection information.
The council will also review the 2019 calendar of scheduled citizens forum, regular work session and regular council meetings.
The board will then review agenda items for Wednesday’s meeting, which will start off with two presentations: Arizona Complete Health Grant Award and Pacific Avenue Athletic Complex update.
Consent agenda items include a $1.6 million contract for paving of 4th Avenue from 32nd to 40th streets to DPE Construction of Yuma; an Assistance to Firefighters Grant Program - Operations and Safety grant agreement for $18,424; four HUD HOME Investment Partnership Program agreements totaling $774,935 in accordance with the 2018 Annual Action Plan; and the final plat for the Park West Unit 5 Subdivision located at South 43rd Trail and West 28th Street.
The resolution consent agenda includes a declaration of the National Fire Protection Association National Fire Code 2018 as a public record and a preannexation development agreement with Tierra Del Sol Construction for properties located on 5th Street.
Three ordinances are up for adoption, two of which would abolish the Community Tree Board and add the duties to the Parks, Arts and Recreation Commission. The third ordinance would declare the right-of-way at the southwest corner of Avenue B and 28th Street as surplus to allow its sale.
The council will also hold a public hearing on a request to amend the city’s general plan to change the land use designation from Suburban Density Residential to Low Density Residential for property located at the northwest corner of the Avenue B½ alignment and 40th Street.
