KAMBWILI ACQUITTED
THE Lusaka Magistrates’ Court yesterday acquitted Chishimba Kambwili after finding him with no case to answer on all three traffic of- fences.
Kambwili was facing three counts of unregistered motor vehicle, a Jaguar bearing the mark CK 900 alleged to be his property.
The matter came up yesterday before magistrate Brian Simachela for ruling and determining if the accused person would be found with a case to answer.
Magistrate Simachela said the evidence given by the prosecution witnesses was not credible but full of lies and malice.
“In this matter, the prosecution failed to conduct thorough investigations thereby abrogating the rule of natural justice, the witnesses’ evidence was full of lies and malice,” he said.
Magistrate Simachela further said the witnesses’ evidence was destroyed in cross examination by Kambwili’s lawyers Keith Mweemba and Christopher Mundia due to lack of evidence to convince the court.
In this matter, Kambwili was facing three traffic offence charges among them being in charge of a Jaguar bearing a false registration mark CK 900 whose real number plate was AOB 2949.
The said vehicle was being driven by Chileshe Chileshe on Dedan Kimathi Road on August 13, 2017 in Lusaka.
In the second count, particulars were that Kambwili permitted Chileshe to drive the said motor vehicle without a driving licence contrary to the Road Traffic Act No 11 of 2002 of the laws of Zambia.
Particulars of the offence in the third count were that on August 13th, 2017 Kambwili failed to display a certificate of insurance on the Jaguar in respect of which the disc was issued.
