FDD RUBBISHES IMPEACHMENT TALK
THERE is no allegation worth raising impeachment calls against President Edgar Lungu as specified by the Zambia Constitution, Forum for Democracy and Development deputy spokesperson Anthonio Mwanza.
Mr Mwanza said there was no constitutional backing for all those calling for the impeachment of President Lungu over his sentiments against the conduct of Constitutional Court Judges in Zambia.
“According to the Constitution, there are ONLY THREE grounds under which a Head of State can be impeached.
“A President can only be impeached on the following grounds: 1. If he has violated the provisions of the Republican Constitution or other law; 2. If he has committed a crime under international law and; 3. If he has committed gross misconduct.
“The Constitution further demands that the motion to impeach the President MUST SPECIFY the PARTICULAR allegations that the President is said to have committed,” he said. He explained that while FDD does not agree with the said alleged sentiments with regards to the judiciary, calls for his impeachment were frivolous and vexatious as they were totally unmeritorious at law.
He charged that the impeachment calls have no legal backing and do not violate the three prescribed grounds for impeachment as stipulated by the Constitution of Zambia, adding that “in fact the callers of the impeachment have failed to give SPECIFIC allegations in accordance with the Constitution other than saying that the President must be impeached for his “attacks” on the judiciary”.
He has referred to Article 108 of the Constitution of Zambia which prescribes specific grounds under which the President of Zambia could be impeached that the President did not commit the violations specified.
He further explained that the motion to impeach a president must be substantiated by the National Assembly with not less than two-thirds votes in support.
He explained that there was no reason in this matter to call for the impeachment of the Head of State.
