M’membe acquitted
FORMER Post Newspaper journalist Abel Mboozi has withdrawn the case where he sued Fred M’membe to court for allegedly concealing company property, amongst other charges because he could no longer
legal fees to pay his lawyers and that he wanted to have the peace of mind.
This matter was scheduled for commencement of trial yesterday before magistrate David Simusamba, however private prosecutor Rabson Malipenga said he had received instructions from the complainant to withdraw the case. “This application is pursuant to section 201 of the Criminal Procedure Court,” he said.
Mboozi took stand in court and confirmed his position to withdraw the case claiming that he had challenges to pay legal fees to his attorneys.
“It is my firm position that I am withdrawing this matter because I have challenges with legal fees to pay my attorneys, and I just want peace,” he said. Magistrate Simusamba admitted the application and acquitted M’membe.
In this matter, M’membe who is the Post Newspapers (in liquidation) proprietor was also charged of impersonating an officer of the Post Newspapers, disobeying lawful orders, concealing property of the company and preventing production of books or papers relating to the company.
