Mboozi absent to withdraw Nchima Nchito’s case
FORMER Post Newspapers employee Abel Mboozi yesterday was not present before the Lusaka Magistrates’ Court to withdraw the personation case against Nchima Nchito.
When the case came up yesterday, a lawyer standing in for Robson Malipenga informed the court that he had been trying to get hold of the complainant to come to court and personally withdraw the matter but he was out of reach.
This matter came up yesterday before magistrate Humphrey Chitalu who had ordered that the complainant be present to withdraw the matter in court.
Magistrate Chitalu in the previous matter had ordered that Mboozi be present in court on November 20th 2017 to hear the application to withdraw the complaint which he had filed last year.
Magistrate Chitalu adjourned the matter to November 29th 2017 to allow the complainant be in court for his withdrawal.
“The complainant’s absence might cause for the acquittal of the accused person, I will grant a short adjournment to allow the complainant to be in court to withdraw his case,” he said.
It is alleged that Nchito between November 1, 2016 and February 2017 at Lusaka with intent to defraud filed court process in the High Court with cause number 2017/HPC/0059 thereby falsely representing himself as an advocate genuinely appointed by the Post Newspapers Limited (In Liquidation).
