Chief Moomba succession case stalls

THE matter in which the late son to Chief Moomba of the Nkoya speaking people of Kazungula was scheduled to come up for a ruling has failed to take off in the Livingston­e High Court.

In this matter, Gabriel Moomba had filed an injunction in the High Court challengin­g any persons, including government officials that did not recognise him as chief to do so after he installed himself as Chief Moomba to replace his father who died in 2015.

But government through the Southern Province Minister Edify Hamukale had warned that it would not recognise him as Chief Moomba because he did not qualify.

On July 2, 2017, Mr. Gabriel Moomba allegedly installed himself as the new chief after the death of his father in April 2015 despite knowing that he did not qualify.

He later went to file to force government to recognise him and he is yet to know his fate when the matter comes up.

The matter was scheduled to come up for ruling but the judge in charge, Justice Ernest Mukulwamut­iyo is in Mazabuka where the court is sitting.

And in a related developmen­t of the same chiefdom, the matter in which Philip Moyo had sued Doreen Moomba who was duly selected to take over the helm of Chief Moomba has been thrown out by the same court.

Philip Moyo who came second when the chiefdom electoral college sat to choose a chief decided to file an injunction in the Livingston­e High Court restrainin­g her installati­on.

But Mr. Moyo lost the case when it came up on November 6, 2017 before Judge Mukulwamut­iyo.

Confusion has continued over who was supposed to be Chief Moomba with the remaining matter being that of Gabriel Moomba.
