Unsettled legal fees land Israeli firm in court
A LAW firm, KBF and Partners has sued an Israelibased company demanding over K100, 000 in unpaid legal fees with interest at current bank lending rates.
In a statement of claim filed in the Lusaka High court, the law firm indicated that On Track Innovations Limited was an Israeliowned company having its offices at ZHR Industrial Zone Rosh Pina in Israel.
The law firm claimed that through an agreement dated August 7, 2012, it was engaged to provide professional legal services for six months on behalf of the said Israeli-owned company during the period it had a contract with the Road Transport and Safety Agency (RTSA).
“By an agreement in writing dated August 7, 2012, we were retained by On Track Innovations Limited to offer professional legal services for the period of 6 months when they had a contract with the Road Transport and Safety Agency.
“Mr Bwalya on behalf of the law firm and Mr Oded Bashan on behalf of the Israeli company executed the mentioned agreement that the firm would provide legal services for the period of six months,” it was submitted.
The firm claimed that it was a term of agreement that the On Track Innovations Limited would pay monthly sum of $2000 for the time for which the agreement would run.
Further that the law firm offered the professional services contracted for and in January 2013 a K106, 000.00 was offered to On Track Innovations Limited but that despite several reminders the company has refused or neglected to settle the said amount owed.
The law firm also claimed that letters and e-mails sent to the Israeli company have gone without response and that the said company has failed to give any valid reason as to why it has failed to settle the amount owned.
Now the Law firm is seeking the court’s indulgence in the settlement K106, 000.00, cost and any other reliefs that the court may deem fit.
